Bagdad Architectural Advisory Committee
Minutes of the November 16, 2005 Meeting
The meeting was called to order at 10:00 a.m. with the following members and staff present: Dr. Charles D’Asaro, Chairman; Mrs. Davis, Committee Member, Mr. Michael Johnson, Committee Member; Mr. David Bailly, Committee Member; Mr. Joshua Wilks, Committee Member; Karin Heaton, Committee Advisor, LaVerne Frye, Office Assistant and Beckie Faulkenberry, Planning Director.
The first item on agenda was Scott Warther 2005-BHAAB-020 requesting installation of a 6’ privacy fence all the way around the property, accessory building, extension of existing roof, and enclose existing garage. Mr. Warther stated that he would paint the fence white; he also stated that house was not historical. Ms. Faulkenberry informed the board that the Land Development Code limits the height of a fence within the front setback line to 4 feet. Dr. D’Asaro stated that was a Land Development Code issue and not within the purview of the Bagdad Board. Mrs. Davis motioned to approve the fence consistent with LDC location and height requirements. Joshua Wilkes seconded, and motion passed 4-0. Mr. Warther’s next items were an accessory building, extension of existing roof and enclosure of existing garage. Mr. Warther stated that all material would be consistent with neighboring houses. Michael Johnson motioned to approve Mr. Warther’s additional request for accessory building, extension of existing roof and enclosure of existing garage in accordance with Building Codes. Mrs. Davis seconded the motion and the motion passed 4-0.
The second item on the agenda was Mr. Robert Hussey 2005-BHAAB-021, request to build a storm shelter between this home and shop. Mr. Wilkes asked if the shelter would be higher than the shop. Mr. Hussey stated no, that he would like it to be the height with a flat roof and would be painted white. Mrs. Heaton asked about the distance between the shelter and shop. Mr. Hussey stated that they were very close but not touching. Mr. Hussey asked how close he could get. Ms. Faulkenberry stated that the Building Department would be able to advise him. Discussions continue concerning the storm shelter. Mrs. Davis motioned for approval and Mr. Wilkes seconded the motion and motion passed 4-0. Mr. Johnson recommended the
installation of a window for an emergency exit.
Dr. D’Asaro asked if the members have a right of privacy and Ms. Faulkenberry responded that yes they do but, that their names are public record. He explained that an applicant had come to him for assistance in filling out her application, telling him that she was referred to him by Planning and Zoning staff. Ms. Faulkenberry assured the board that she would advise her staff not to refer applicants to board members.
Dr. D’Asaro expressed concern with the board regulating exterior paint in the Bagdad District. Ms. Faulkenberry noted that the LDC does give the board authority to regulate paint color. The members also voiced concerns about granting variances to code requirements not specific to Bagdad. Ms. Faulkenberry stated she would speak to the County Attorney concerning the issue and report back to the board.
