The regular meeting of the Santa Rosa County Building Code Board of Adjustments and Appeals was held November 14, 2007, at 3:00 p.m. in the conference roomof the Santa
Rosa CountyBuilding Inspection Department located at 6051 Old Bagdad Highway, Milton, FL32583.  Board members present wereMr. Charles “Pete” Southerland, Chairman;Mr. James “Larry” Hall, Vice Chairman;Mr. William J. Blackman, Mr. Frank Harold and Mr. Danny Holt.

Building InspectionDepartment staff in attendance was Mrs. Rhonda Royals, Deputy Building Official; Mr. Randy Jones, Compliance Investigator;Mr. Bobby Burkett, Compliance Investigatorand Mrs. Robyn Leverton, Administrative Assistant I.

Mr. Tom Dannheisser, County Attorney, was present forthe meeting.

Mr. Pete Southerland, Chairman, called the meeting to order at 3:00 p.m.

A court reporter from Anchor Court Reporting (432.2511) inPensacola was present for the “Formal Hearing” portion of these minutes.

The audio/recording system was inoperable therefore there are no tapes of the meeting.

Approval of Agenda:
There were no amendments to the agenda.  Mr.Harold made a motion to accept the agenda.  Mr.Blackmanseconded the motion.  The motion carried witha unanimous vote.

Approval of Minutes:
Mr. Harold made a motion to approve the minutes from the October 10, 2007meeting. Mr. Hallseconded the motion.  The motion carried witha unanimous vote.

Next Meeting:
The next regularly scheduled meeting is Wednesday, January9, 2008, at 3:00 p.m. in the Building Inspection Department Conference Room.

Old Business – Formal Hearing
Donnarae Morris vs. John D Roche’ d/b/a Roche’ Enterprises of Pensacola, Inc.
Rhonda Royals introduced the case and read the charges.

Ms. Donnarae Morris alleges that Mr. Roche’ has violatedthe Building Code by failing to obtain the required inspections on a re-roofing job he performed at her home located 7262 East Bay Blvd, Navarre, FL  32566. 

Alleged Violation ofthe Florida Building Code:
1. Section109.5 Inspection Requests.  It shall be the duty of the holder of the building permit or their duly authorized agent to notify the building official when work is ready for inspection.  It shall be the duty of the permit holder to provide access to and means for inspections of such work that are required by this code.

Rhonda said that a building permit was pulled on 6.13.05 for a re-roof.  The application stated a construction cost of $2000.  The first inspection was turned down since the roof
was metal and the value was greater than $2500, meaning a Notice ofCommencement was required. There were no other inspections requested.  Roche’ had not renewed his license as of October 1, 2007; he is now State Certified, but this permit was pulled on his registered license.  Today’s action will be against his State and/or his local license.

Randyspoke briefly about the roof stating there are several installation problems that would be code violations.  He said the roof would not pass a final inspection.

Donnarae Morris and her Fiancé, Gary Riddell came to the podium.  Donnarae addressed the Board.  She said the permit was pulled after the roof was installed.  She was not
presented with a Notice of Commencement to sign, the roof is faulty and it needs a final inspection.  She asked the Board what she could do to get a final inspection passed.

A discussion ensued between the Board, Ms. Morris and Mr. Riddell.

Mr. Harold made a motion to find Mr. John D Roche’ guilty of a willful violation of the Florida Building Code, i.e., failure to call for inspections. Mr. Blackman seconded the motion. The motion passed with aunanimous vote.

Mr. Harold made a motion for the State to investigate the violation. Mr. Blackman seconded the motion.  The motion passed with a unanimous vote.

Mr. Harold made a motion to revoke Mr. Roche’s local license for five (5) years and his State license indefinitely.  Mr. Blackman seconded the motion.  The motionpassed with a unanimous vote.

Mr. Blackman made a motion to adjourn the meeting.  Mr. Harold seconded the motion.  The motion carried with a unanimous vote.


The meeting was adjourned at 3:30p.m.
