BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS
MEETING MINUTES
October 14, 2009

The regular meeting of the Santa Rosa County Building Code Board of Adjustments and Appeals was held October 14, 2009, at 2:30 p.m. in the conference room of the Santa Rosa County Building Inspection Department located at 6051 Old Bagdad Highway, Milton, FL 32583. Board members present were Mr. Frank Harold, Chairman; Mr. Danny Holt, Vice Chairman; Mr. William J. Blackman, Mr. Charles “Pete” Southerland and Mr. James “Larry” Hall.

Building Inspection Department staff in attendance was Mr. Skip “Wilson” Tompkins, Compliance Division Superintendent; Mr. Randy Jones, Compliance Investigator; Mr. Bobby Burkett, Compliance Investigator and Mrs. Robyn Leverton, Administrative Assistant I.

Mr. Tom Dannheisser, County Attorney, was not present for the meeting.

A court reporter was not present for the meeting.

Mr. Frank Harold, Chairman, called the meeting to order at 2:30 p.m.

Approval of Agenda:
There were no amendments to the agenda. Mr. Blackman made a motion to accept the agenda. Mr. Southerland seconded the motion. The motion carried with a unanimous vote.

Approval of Minutes:
Mr. Blackman made a motion to approve the minutes from the September 9, 2009, meeting. Mr. Southerland seconded the motion. The motion carried with a unanimous vote.

Next Meeting:
The next regularly scheduled meeting is Wednesday, November 11, 2009, at 2:30 p.m. in the Building Inspection Department Media Room. However the Board, with a unanimous vote, decided, unless something pressing came up, to hold the next regularly scheduled meeting on Wednesday, January 13, 2010.

New Business - Probable Cause
Robert Bonsignore vs. Jeff Milowitz d/b/a Emerald Coast Construction – State Registered Contractor #RR28281111

Randy stated that Mr. Milowitz was in attendance; however Mr. Bonsignore was not present at the meeting.

Mr. Southerland made a motion to dismiss the case due to complainant’s lack of attendance for the second time. Mr. Blackman seconded the motion. The motion passed with a unanimous vote.

Open Forum
A brief progress update concerning the amendment of ordinance 2006.38, an amendment that would allow the Building Code BOAA the authority to impose fines against contractors, was provided by Randy Jones. A draft of said ordinance was submitted to the Building Department minutes before the meeting. Randy made a copy of the draft for each Board member to peruse. After review of the draft…Mr. Southerland made a motion to ask the Commissioners to adopt this ordinance amendment. Mr. Blackman seconded the motion. The motion passed with a unanimous vote.

Mr. Southerland made a motion to recommend to the Commissioners that the monies collected from these fines, be directed to the Building Department in order to offset the cost of investigations. His motion died due to lack of a second.

A discussion ensued amongst the Board members with the majority agreeing that at this point, in order to proceed in a timely manner, they wish to pursue only the ordinance change as drafted; possible adding more changes at a later date.

Per Tim Tolbert, Tom Dannheisser will present the ordinance amendment to the BOCC, the BOCC will advertise for a Public hearing and then schedule such prior to the their approval of the ordinance change.

Mr. Southerland made a motion to adjourn the meeting. Mr Blackman seconded the motion. The motion carried with a unanimous vote.

The meeting was adjourned at 3:00 p.m.
