SANTA ROSA COUNTY
BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS
September 9, 2009
The regular meeting of the Santa Rosa County Building Code Board of Adjustments and Appeals was held September 9, 2009, at 2:30 p.m. in the conference room of the Santa Rosa County Building Inspection Department located at 6051 Old Bagdad Highway, Milton, FL 32583. Board members present were Mr. Frank Harold, Chairman; Mr. Danny Holt, Vice Chairman; Mr. William J. Blackman, and Mr. Charles “Pete” Southerland.
Building Inspection Department staff in attendance was Mr. Tim Tolbert, Building Official; Mr. Randy Jones, Compliance Investigator; and Mr. Bobby Burkett, Compliance Investigator.
Mr. Tom Dannheisser, County Attorney, was not present for the meeting.
A court reporter was not present for the meeting.
Mr. Frank Harold, Chairman, called the meeting to order at 2:30 p.m.
Approval of Agenda:
There were no amendments to the agenda. Mr. Southerland made a motion to accept the agenda. Mr. Blackman seconded the motion. The motion carried with a unanimous vote.
Approval of Minutes:
Mr. Southerland made a motion to approve the minutes, as amended, from the August 12, 2009, meeting. Mr. Blackman seconded the motion. The motion carried with a unanimous vote.
The next regularly scheduled meeting is Wednesday, October 14, 2009, at 2:30 p.m. in the Building Inspection Department Media Room.
New Business - Probable Cause
Robert Bonsignore vs. Jeff Milowitz d/b/a Emerald Coast Construction – State Registered Contractor #RR28281111
Randy Jones was called today and asked to proceed with case by Mr. Bonsignore even though Mr. Bonsignore was unable to attend.
Mr. Blackman made a motion to table the case until all parties can be present. Mr. Southerland seconded the motion. The motion passed with a unanimous vote.
A brief progress update, concerning the ordinance that would impose fines against contractors, was provided by Randy Jones. A slight change was requested by Tom Dannheisser; chapter 489 of the Florida Statutes was referenced, that reference had to be changed to reflect the local county ordinance number, 2006-38. As a reminder, the Board had voted for the minimum of $250 to a maximum of a $5,000 fine for all violations. Mr. Dannheisser will write up the ordinance and then send to the Commissioner’s.
Per Tim Tolbert, Tom Dannheisser will present the ordinance change to the BOCC, the BOCC has to advertise for a Public hearing and then schedule such prior to the their approval of the ordinance change.
The subject of potential fees for appeal cases was also addressed however the Board decided they would like to make sure the previously mentioned ordinance change, regarding fines against contractors, is approved prior to presenting another change.
Another question, brought up by one of the Board members, was if the County could force the complainants or violators to type up their correspondence rather than submit handwritten documents.∗
Mr. Holt made a motion to adjourn the meeting. Mr Blackman seconded the motion. The motion carried with a unanimous vote.
